"Piracy in the waters off the Horn of Africa (HOA) has become a multi-million dollar venture annually for modern day pirates because vessel ownership groups continue to pay ransoms. The seizing of cargo ships and ransom demands have harmful economic impacts to companies and countries. Piracy operations directly threaten U.S. interests and citizens, as displayed during a recent kidnap for ransom action that led to the deaths of four Americans. In addition, piracy affects global trade. Despite significant multinational counter piracy efforts, which has included U.S. agencies and military forces, merchant vessels continue to be pirated regularly. Piracy off the coast of Somalia exists largely because Somalia is a failed state with little to no rule of law or domestic law enforcement capability. The economic situation of the people living in Somalia is dire. A lack of viable employment opportunities, a shortage of arable land, continuing drought, and increasing competition from other nations fishing off the coast, have all affected the standard of living. The conventional wisdom is that the solution lies ashore; meaning the establishment of good governance and economic development in Somalia, but the international community has displayed no interest to engage in nation building. This thesis will describe the challenges and ineffectiveness of current multi-national counter piracy operations and discuss how the international community can best combat piracy in the HOA region from a maritime perspective. By reviewing how states have historically responded to piracy and examining international legal approaches, the author will propose a multi-tiered coalition-based naval force solution, which uses all the traditional advantages of naval power to eliminate piracy without resorting to nation building."--Abstract.

The rationale for writing this book is a desire to highlight the utility of combining the efforts of criminologists, security practitioners, and policy makers in confronting crime problems such as maritime piracy. The study examines maritime piracy incident trends over the past few years and presents an explanation for the significant reduction of incidents in East Africa and offers a new approach in constructing a crime-reducing framework applicable to piracy, as well as other crime problems. The intent is to add relevance to the pursuit of social science research crime data collection and analysis using criminological theories (frameworks) and planning techniques for developing crime interdiction strategies that are useful to security practitioners and policy makers. Emphasis is on obtaining readily available data using recognized social science methods to analyze the maritime piracy crime phenomenon for planning and developing the strategies and actions that produce desired outcomes in support of crime reduction. Protecting the maritime infrastructure essential for this trade from terrorism is a major concern for the international community. This book originates from the NATO Advanced Research Workshop (ARW) Counter-Terrorism Lessons from Maritime Piracy and Narcotics Interdiction, held in Copenhagen, Denmark, in May 2019. Participants in the three-day workshop included policymakers, senior military officers, and academics from NATO member states, international organizations, and two partner nations: Colombia and Israel. Their extensive discussions focused on methods for protecting critical maritime infrastructure, such as ports, supplies, and personnel, from seaborne terrorist attacks. Maritime piracy off the coast of Somalia was first recognised as a global concern in 2008 after the hijackings of World Food Programme vessels. It remains a serious impediment to international maritime trade and a significant risk to seafarers. Bringing a criminological perspective to the subject, this book presents an analysis of Somali piracy by means of Routine Activity Theory and regulatory pluralism. Based on data from a range of sources, including published documents and in-depth interviews with representatives of industry, government, and international organisations, the study concludes that no one institution or policy will suffice to control Somali piracy. Accordingly, a number of different actors and institutions have a role to play in reducing the supply of motivated offenders, the vulnerability of prospective victims, and in enhancing guardianship. The outbreak of Somali piracy that started in 2008 has prompted a similar revolution in maritime security. Private security companies began operating armed escort vessels to protect merchant shipping against pirates off the Horn of Africa. Private Anti-Piracy Navies is intended to provide a contextualized understanding of the historical origins, current state, and future prospects of this fast-changing sector. Centuries ago, the British East India Company used a private navy against piracy in the same waters with much success. Yet since then, international law has evolved to more tightly regulate the use of force by civilians, and to afford greater protections to suspected pirates. Thus, the development of what are in effect private warships has presented numerous legal and regulatory problems. How can the companies that operate these vessels be effectively licensed? Under what circumstances should they be allowed to use lethal force? This book explains how regulators in industry and government have attempted to answer such questions, and highlights the remaining areas of uncertainty. It also addresses the economic factors that drive the struggle between pirates and anti-piracy forces. Of equal concern are operational considerations such as defensive tactics, logistics, and rules of engagement. Global commons are domains that fall outside the direct jurisdiction of sovereign states - the high seas, air, space, and most recently man-made cyberspace - and thus should be usable by anyone. These domains, even if outside the direct responsibility and governance of sovereign entities, are of crucial interest for the contemporary world order. This book elaborates a practice-based approach to the global commons and flows to examine critically the evolving geopolitical strategy and vision of United States. The study starts with the observation that the nature of US power is evolving increasingly towards the recognition that command over the flows of global interdependence is a central dimension of national power. The study then highlights the emerging security and governance of these flows. In this context, the flows and the underlying global critical infrastructure are emerging as objects of high-level strategic importance. The book pays special attention to one of the least recognized but perhaps most fundamental challenges related to the global commons, namely the conceptual and practical challenge of inter-domain relationships-between maritime, air, space, and cyber-flows that bring about not only opportunities but also new vulnerabilities. These complexities cannot be understood through technological means alone but rather the issues need to be clarified by bringing in the human domain of security.
