This monograph investigates the International, European and Commonwealth Caribbean approaches to human trafficking from an Analytical Eclectic perspective. It presents a compelling, empirically based argument that although there is currently a panoply of measures aimed at preventing human trafficking, prosecuting offenders and protecting trafficked victims in both Europe and the Commonwealth Caribbean, these measures have in practice been fraught with a number of challenges, whether of a normative, institutional or individual nature. The continued existence of these challenges strongly suggests that there exists a 'disconnect' between anti-trafficking law and practice which is not peculiar to small-island developing States since they also extend to developed States, including the United Kingdom. Although these challenges are not insurmountable, this monograph advances the argument that sustained social, economic, political and legal commitments are both necessary and desirable, and that without such commitments, only pyrrhic victories would be won in the fight to eradicate the scourge of the twenty-first century. Given the importance of the issue of human trafficking and its inescapable impact on victims, families, communities, nations, regions and the international community as a whole, this monograph will serve as an important resource for policy makers, scholars, students and practitioners actively working in this increasingly dynamic area of law.

The book analyses the difficulties the International Criminal Court faces with the definition of those persons who are eligible for participating in the proceedings. Democracy is in distress! The Secretary General of the 47-nation Council of Europe, Marija Pejčinović Burić, has highlighted a “clear and worrying degree of democratic backsliding” in her latest annual report on the state of democracy, human rights and the rule of law across the continent. “In many cases, the problems we are seeing predate the coronavirus pandemic but there is no doubt that legitimate actions taken by national authorities in response to Covid-19 have compounded the situation. The danger is that our democratic culture will not fully recover,” said the Secretary General. “Our member states now face a choice. They can continue to permit or facilitate this democratic backsliding or they can work together to reverse this trend, to reinforce and renew European democracy and to create an environment in which human rights and the rule of law flourish. “This is the right option for the 830 million people who live in the Council of Europe area.” Based on the findings of different Council of Europe bodies, including the European Court of Human Rights, the Secretary General’s report assesses recent developments in areas including political institutions and judicial independence, freedom of expression and association, human dignity, anti-discrimination and democratic participation. The report encourages member states to use existing and future Council of Europe mechanisms to address many of the challenges identified, on the basis of the following key principles: - National authorities should return to fundamental democratic principles and recommit to Council of Europe legal standards, including the implementation of judgments from the European Court of Human Rights; - Member states should fully embrace the multilateralism embodied by the Council of Europe for more than 70 years; - Covid-related restrictions and measures must not only be necessary and proportionate, but also limited in duration; - National authorities should embrace democratic culture, recognising where their words, activities or legislation have diminished that culture by reducing civic space, by intimidating or preventing individuals, organisations and NGOs from exercising their freedom of speech or assembly, or by excluding people from participating fully in society.

This book describes the nature of trafficking in persons in West Africa, focusing on labor and sexual exploitation in the region, and recommends tailor-made solutions established by the Catholic Church in light of governmental authorities’ failure to effectively combat this scourge of humanity. While states’ efforts to fulfill their international obligations in developing anti-trafficking legislations are recognized, their failure to carry out prosecutions of offenders and ensure protection of the victims reveals that law alone is not a sufficient instrument for realizing human rights and improving people’s lives. Faced with the sobering background of less than successful efforts by governmental entities to end the trade in humans, this research study recommends adopting essential elements of Catholic social teaching, which rests on the inherent dignity of human beings allowing the development of political, socio-cultural, and religious reforms that will increase the effectiveness of existing legislation designed to combat trafficking. This faith-based approach highlights the role that religion may play in fulfilling the discretionary provisions of the Palermo Protocol by promoting the welfare and protecting the life and dignity of the victims. Additionally, religion is composed of sound moral ethics that determine people's behavior to refrain from the sinful conduct of trafficking. It also creates a sense of ethical responsibility that promotes supply chain transparency and ethical purchasing as well as advocating social reforms and anti-trafficking legislations initiatives. In fact, the author's approach, may be a model for other regions in the world and will be of interest to scholars, law and policy makers, human rights advocates and law enforcement agents working in the field of trafficking in persons.
